2: Inspection Procedure
- Identification of Establishments : the establishments which are to be inspected would be identified using the random computerized risk assessment.
- b. Inspection byJoint Team:
- Inspection will be carried out by a joint team of inspectors.
- The inspecting team will consist of minimum 2 inspectors and one of the following officers, Assistant Labour Commissioner, Labour Enforcement Officer, Assistant Director Factory as per their availability.
- Inspection report in 48 hours:
- The inspection report would be uploaded / submitted by the inspecting team on the departmental portal with a unique number.
- The unique number will be used by the units / establishments / factories to view and download the inspection report within 48 hours from their web portal account.
- Non-Compliance Notice
- The department may issue a notice to units / establishments / factories to rectify defects / deviations / non-compliance observed as part of inspection
- The establishment to do the necessary / appropriate compliance within 15 days and inform the Labour Department about the same after uploading the compliance report.
- Final Action>
- Acceptance of compliance report / initiation of proceedings.
3:Checklist
- Whether the establishment is registered under Contract Labour Act.
- Whether contractor has obtained licenses under the Act.
- Whether license has been renewed as per Rule 29.
- Whether canteen service has been provided by the employer employing 100 or above contract labour.
- Whether provision of rest house has been provided.
- Whether facility of drinking water, urinal, latrine and hand washing have been provided.
- Whether the first-aid box is provided with all necessary medicine and instruments.
- Whether time and place for payment has been displayed.
- Whether employer has nominated a representative in presence of which payment of wages is to be made to contract labour.
- Whether register of contractor is maintained by principal employer.
- Whether attendance register of contract labour has been maintained in Form 13.
- Whether contract labour are given employment card.
- Whether muster roll, wages register, deduction register, overtime register, penalty register and register of advances have been maintained.
