The headquarter of the Labour Commissioner's Organization at Kanpur is headed by the Labour Commissioner, Uttar Pradesh, who is the Head of the Department. The headquarter is committed to carry out its functions timely and effectively with the assistance of Additional Labour Commissioners, Director of Factories, Director of Boilers and the Finance Controller. The commitments envisaged are effectively honoured in favour of stake holders through the various sections, which are independent units itself entrusted with specific responsibility. These sections are supervised by individual Sectional Officers indicated in the organogram mentioned above.

One of the important role/work of the department is to maintain industrial peace in the state. To maintain industrial peace and harmonious relations amongst the workers and the employers, officers of the department have been deputed. Additional Labour Commissioner/Deputy Labour Commissioners/ Assistant Labour Commissioners and senior Labour Enforcement Officers posted at headquarters and in 20 regional officers and districts have been notified as Conciliation Officers. Conciliation Officers try to reach an agreement between the parties. Through conciliation strikes, lockouts, closures, lay-offs, are avoided.

The Labour Department of U.P. is entrusted with the responsibility of enforcement and administration of 33 labour laws and related rules.

To ensure effective and widespread enforcement of the labour laws and rules, there are at present 17 regional officer's in the Labour Commissioner Organisation under the supervision of Regional Additional/Deputy Labour Commissioners.

Assistant Labour Commissioners and Labour Enforcement Officers have been posted in these regional offices. Labour Enforcement Officers are posted in regional head quarters and also in district head quarters and also in some of Tehsil head quarters. This is worth mentioning that posting of Labour Enforcement Officers at Tehsil head quarters have been, as at present, possible only in few Tehsil head quarters and these Labour Enforcement Officers are also entrusted with the responsibility of enforcement of these labour laws at block levels also. With a view to effective and widespread enforcement of prescribed minimum wages, the Government of U.P. has in addition notified “Inspector” under the Minimum Wages Act all Tehsildars, Niab-Tehsildas, Block Development Officers, Assistant Development Officers (Agriculture), Co-operative, Panchayat in the geographical limits of their respective territorial jurisdictions. This has been the experience that despite this arrangement there has been no significant improvement in respect of effective enforcement of prescribed minimum wages. It is therefore considered advisable that labour enforcement machinery be extended upto block levels.

The State Government is fully committed to ensure the effective enforcement of prescribed minimum wages and other service conditions in the best interests of workers in the unorganized sectors. With a view to this, the Labour Commissioner, U.P. has fixed targets of inspections under various labour laws. The targets have been so devised as to ensure not only quantitative performance but also in addition qualitative performance by way of fixation of targets in the nature of number of benefited workmen and the amount of pecuniary benefits accruing to the workmen. Regional officer's in distribute these targets amongst Labour Enforcement officers and progress is reviewed periodically at the regional officers level and also at of Labour Commissioner, U.P.

According to 1991 census the number of working children in country was 110 lakh, it was an estimate only. Census, 1991 estimated it about 14 lakh working children in the State of U.P. The 23 districts out of 70 districts have been identified as child labour prone districts in U.P., wherein incidence of child labour is high in industries, like carpet weaving; glass and glass bangle making; brassware; lock and hardware; pottery and ceramics; and beedi etc.

After the judgement of Hon'ble Supreme Court dated 10-12-96 , a total number of 91,582 child labourers have been identified through three surveys conducted by the State Govt. in hazardous/non-hazardous occupations/processes.

In compliance of directions given by the Hon'ble Supreme Court the preference has been given to rehabilitation of child labourers identified during survey/inspections and at the same time legal action has also been initiated against the offending employers of child labourers identified in hazardous industries.

One of the important role/work of the department is to maintain industrial peace in the state. The Labour Welfare centers were established by the Government to provide the labourers of the state with the facilities of medical Care, games & sports, reading studies and entertainment. Initially there were 75 Labour Welfare centers in the State but at present there are 43 welfare centers are functional, all running in Government buildings.

The Establishment Section is one of the main sections of Labour Commissioner Organization. Main work of this section is to maintain all records of employees like date of joining, maintain service book, leave information, present working status and location where employee is working. Establishment also maintains the record regarding retirements as how many employees are going to retire in current month or coming month or coming year. Establishment maintains records of Class III employees, Class II and Class I officer. They submit monthly reports to Research & Statistics section for compilation. Establishment section in Regional Offices follows the same working as that of Head Office. They submit monthly reports to Research & Statistics section for compilation.

In the section letters are received from different sources and are marked by authorized officer and it sends to concerned section for further action and disposal. It also delivers letters and other office related documents from organization through various services as Registered Post/Speed Post or ordinary Post to other organization or to both to the regional offices or other Public/Private Officer or to person concerned.

Keeping in view the vision and mission of the department the library has been established since 1949 “to promise knowledge generation and application through its effective dissemination” The Library of U.P. Labour Commissioner Office, Kanpur is well equipped, specious, centrally air cooled and also with air conditioned room for officers, centrally located and functionally well ventilated building with seating capacity of 80 readers, spread over with big hall and two small reading rooms. Users can use this library on all working days that is from Monday to Friday. Timing 9:30 AM to 6:00 PM.

This is the Special Library used by Gazetted and non Gazetted officers i.e.staff members of department, Research Scholars, Lawyers and students but circulation process is only for staff members and for others only reference and reprography services are available.

The Publicity Section is situated at Head Office of Labour Commissioner Organization. It collects all information related to Labour from different sources of media and inform the Labour Commissioner, and they also bring the orders or decisions, notifications of government related to labour in notice of common person using print and media. Publicity Section is the bridge between the common person/labour and government.

They have the responsibility to arrange Press conferences when required, day to day press release and publication of advertisements about the steps taken by the government with regards to the welfare of Labour.

Computer cell was established in 1994-1995 in Labour Commissioner Office, Kanpur. At present all the computer systems are connected with Networking in the Office through LAN, Server situated at computer cell. Computer and peripherals with Internet facility have been provided in officer s rooms, camps and sections of the office.
Computer cell works for -

  • Preparing online/offline software through Govt. Agencies.
  • Website updating and maintenance.(Latest G.O.s,Transfers,Scheme,News,Tenders etc.)
  • Keeping Biometric attendance record of the office.
  • All type of payments through E-Payment.
  • Preparing salary of all officer s and employees.

Labour Department, UP Industrial Disputes Act, 1947 and the Industrial Disputes Act, 1947 (Central) under disputes between workers and employers settle negotiations / agreements are made, but through talks / agreement through the resolution of disputes in the event that there is a judicial verdict is made through the process helps to maintain the industrial peace.


The Branch Secretariat section under consideration by reference and publication of awards has been done as a result of which various campaigns Tribunal / Labour Courts highly-old forward has ensured Awards also published.

The Trade Union Section deals with all matters connected with the administration of the Indian Trade Union Act, 1926, regulations made under that act and / or other legislation connected with Trade Union, in the whole state of Uttar Pradesh.

These matters would include registration of Trade Unions; registration of changes in constitution; addresses of Trade Unions; registration of amalgamations and dissolution of Unions; securing submission of Annual Retruuns.

This Section ensures the certification of Standing Order in accordance with the Industrial Employment (Standing Order) Act, 1946. It requires employers of Industrial Establishments to formally define conditions of employment. In Uttar Pradesh, the Government has directed that this Act shall be applicable to all the Industrial Establishments in the State. For those establishments employing less than 20 workers, the employer voluntary applies for certification of the Standing Order in accordance with the Act published in Uttar Pradesh Gazette 1946.

This Section handles the maintenance work of Labour Colonies, setup according to the Industrial Housing Act 1955. The main objective of these colonies is to provide houses at low and affordable rent to the labourers who live outside the Industrial premises. The Government allots budget for maintenance work. This budget is divided in two parts, one for emergency works and the other for predefined works. On the basis of estimated cost, the work of maintenance of these colonies can be done by any of the following processes:

  • Piece Work Agreement (P.W.A)
  • Quotation Notice
  • Tender Form

The Finance & Accounts is an important Section of Labour Commissioner Organization. This Section deals with all Finance & Accounts related work like, Budget distribution among Regional Offices for different Sections, taking monthly and yearly expenditure reports from different Regions, compilation of these reports, sending the overall report to Government, creation of Budget for new plans approved by Government, bill submission for payment, preparation of salary of all employee, maintenance of GPF passbook of employees etc. Finance & Accounts Section is available at all Regional Offices and they are responsible for giving monthly and yearly reports to the Finance & Accounts Section of Head Office. Finance & Accounts Section of Head Office is directly responsible for giving answers to Government. They take monthly reports of expenditure from each Section.

Nazarat deals with all matters related with Office Buildings, Furniture, Computers, Telephone, Summer and winter liveries. Hot and cold weather arrangements, Cycle Stand, Opening and Closing of office, Watch and ward arrangement, Purchase of all stores use in the office of the Labour Commissioner.

The Planning Section is situated in the Head office of Labour Commissioner Organization. It is a nodal section and depends upon other divisions for information to be submitted further to other Ministries/Departments/Agencies. The major activities include :

  • Formulation of Five Year Plans
  • Formulation of Five Year Plans
  • Commission relating to formulation of Five Year & Annual Plans
  • Formulation of TSP/SCP
  • Formulation of Women Component Plan
  • All Parliament Questions (both LS/RS)
  • Coordination of material related with 20-point programme
  • Preparation of material for Annual Report related to plan programmes
  • Supply of material for Parliamentary Standing Committee on Labour Plan schemes.
  • Work related to Information Technology Scheme
  • Processing & Monitoring of Research Projects under GIA scheme
  • Computerization of data
  • Inspection of the offices of NGOs/VOs as and when required
  • Monitoring of plan schemes of the Ministry
  • Attending all liaison work with the Planning Commission.
  • Directorate of Boilers

With a view to provide safe and healthy work environment, regulation of working hours, welfare measures, timely payment of wages etc. and the maternity benefit to the women workers, the various provisions of the following Acts and the rules made there under, are ensured through inspection of a factory. The inspections of factories are carried out by regional Assistant Director of Factories, who are notified as “Inspector” under the Factories Act, 1948.

  • The efficiency section situated at Office of Labour Commissioner basically conducts on-spot technical studies / survey in the matters referred by Enforcement Section and conciliation wing of Labour Commissioner Organization.

    Survey Reports are being prepared by this section on the basis of on-spot technical studies, work as a tool to resolve the concerned disputes.

    • Job Evaluation
    • Merit Rating
  • Efficiency section of Labour Commissioner's Organization try to make work culture of industries strong and to improve the productivity with the following schemes.

Boiler is a hazardous equipment which generates steam at high pressure and temperature and liable to explode under abnormal conditions. In case of accident there are always chances of loss of life of workmen and property of Industry.


Research & Statistics Section at Head Office collects data from different departments for compilation after which combined MIS report is prepared and sent to the Government. Similarly, Research & Statistics Section of Regional Office collects all information from different sections, compiles it and sends combined information to Research & Statistics Section of Head Office. Regional Offices also collect some more information from District Offices per year and send it to Head Office.

The Training Cell is an important section in the Labour Commissioner Organization where the training of all employees and workers is done. This section exists only at Head Office level.
